I thought my sister was exaggerating about her HOA fining her $75 for a Biden sign, then I read the bylaws myself
My sister lives in a suburb outside Columbus and she got a $75 fine last spring for a small political sign in her yard. I figured she was leaving out some detail, like it was huge or she left it up way past the election. Then I actually read her HOA rules and there it is in plain writing, no political signs of any kind, no time limit, nothing about size. She appealed at the board meeting and a guy on the board literally said they dont want the neighborhood looking divided, which is a wild thing to say about a piece of cardboard. Has anyone else dealt with an HOA rule like this, and did appealing it actually go anywhere for you?
We had almost the same rule in my old neighborhood, no political signs at all, and a bunch of us got hit with fines during the last election. What actually worked was getting a few neighbors together and going to the board as a group instead of one person complaining alone. We showed up with a lawyer's letter that pointed out our state has a law saying HOAs cant fully ban political signs, they can only limit the size and how long they stay up. The board folded pretty fast once they knew they were on the wrong side of state law and could get sued. Your sister should look up Ohio rules on HOA political sign bans before she pays that fine, because a total ban might not even be legal there. Also ask for the fine in writing with the exact bylaw number, that paper trail is what got our fines dropped and the rule changed.
